Terms of Service

1. Introduction

By us, we, we mean the provider of such services, also known as Mist Weather Media.

By you, we mean you, the user that this applies to.

By Service, we mean our services (Mist Streaming, weatherscan.net, weatherstar.dev)

Due to our location being in the United States of America, all laws from such government apply to this as well, regardless of your current location or place of residence/citizenship.

Thank you for considering Mist Weather Media. This Terms of Service outlines our rules and intended usage of our Service. Faliure to comply will result in one of the following actions taken in the section called 5. Punishments.

2. Service Usage

You may use this Service to:

• Stream your own content, as well as content you have permission to stream on Mist Streaming.
• Use our simulators distributed on weatherscan.net and weatherstar.dev.
• Create and monetize content using our simulators distributed on weatherscan.net and weatherstar.dev.

You may not use this Service to:

• Slander, spread hate speech, bully, or cause harm to any person
• Use this service in an attempt to portray yourself as a different entity without permission with such entity (person, company, etc)

We also prohibit these following actions against our Service:

• Hacking
• Phishing
• Exploiting
• Blackmail
• Leaking

3. Privacy Policy

On our simulators hosted on weatherscan.net and weatherstar.dev, your IP address is automatically grabbed to obtain weather data for such simulators. Optionally, you may send in preset geocodes (latitude, longitude) as well as other location data to configure such simulators. Any data set is not sent to us, nor any third party or server, and is kept in your computer.

On Mist Streaming, we only log viewcounts annoymously, unless you stream on such platform, in which we collect your e-mail address for the purpose of password resets - we do not sell or give such data to any third parties. On our panel, it may ask you for a first name - this is NOT us asking for the first name - as you should be given instructions to put your channel's name, not your first name. We will promptly tell you if you have entered your first name into such panel. This data is also not sold or given to any third parties, nor used by us if you do give your first name.

4. Copyright

If you are the legal owner of copyright that has been unlawfully distributed on our Service, you may contact us at support@mistwx.com. If we determine that such content is a infringement against the Digital Millenium Copyright Act, the infringing copyrighted material will be removed, and the user will get a warning. Further actions for repeat infringers are listed in the "Punishments" section of this Terms of Service.

5. Punishments

For first time offenders of copyright, the user will be given a warning. If any repeating actions of copyright infringement occur, the user may be restricted to access our services, including blacklist from our streaming services and if severe enough, a permanent ban from our Service.

Any actions against our Service (such as hacking, leaking, etc) described in 2. Service Usage will be permanently barred from our Service, regardless if this is a repeat offense or the first time this happened. This is to ensure the reliability and security of our Service.

Otherwise, if we determine that someone is using our services in ways we don't allow, we will give them a warning. Once this hits 3 warnings, the offender will be banned from our Service.
